The 58th Colloquium of the SNU Law Research Institute Legal Theory Research Center
"The Psychology of Contract Compliance: Is Contract Compliance a Matter of Fidelity to Promises or Acceptance of Risk?"

  • Date & Time: Wednesday, March 26, 2025, 7:00 PM – 9:00 PM

  • Speaker: Tae-Kyung Gahng | Research Fellow, Korean Institute of Criminology and Justice

  • Presentation Summary:
What does people’s belief in contract compliance mean? How does this belief influence contractual judgments? To answer these questions, the speaker proposes two key factors of contract compliance beliefs: promissory fidelity and risk acceptance. Promissory fidelity is defined as the attitude of faithfully fulfilling a contract as a promise aligned with the expectations of both parties. Risk acceptance, on the other hand, is defined as the willingness to bear the inherent uncertainties in a contract. Based on these factors, the speaker has developed and validated a contract compliance belief scale to clarify the structure of such beliefs and analyze their impact on contractual judgments during the formation and execution of contracts. This empirical study aims to provide psychological insights into the relationship between people’s intuitive beliefs about contract compliance and the principles of contract law.
